Pegasus Flight Delay Compensation

Pegasus flight delay compensation.

How to claim for delayed flight? And how much can you get?

Even though Pegasus is not a European airline, on some of its flights you are protected under the European law. If it’s a Pegasus flight departing from Europe, your air passenger rights are protected by the Regulation (EC) 261/2004 and Regulation UK261. If your Pegasus is heavily delayed, you are entitled to receive care from the airline, and, in some situations, flight delay compensation. How to claim compensation for a delayed flight?

One of the options is to let professionals deal with this.

Or, you can pursue flight delay compensation on your own.

1. Pegasus Flight Delay Compensation: EU / UK Regulations

In Europe, there are regulations establishing rules on flight compensation.

These are the EU Regulation (EC) 261/2004 and the UK Regulation UK261. These regulations are almost identical. The regulations state that in the event of a long delay, passengers are entitled to flight delay compensation.

If you reach your destination 3 or more hours later than scheduled, and it is due to airline’s fault, you have a right to delay compensation. With non-EU and non-UK airlines such as Pegasus, it applies only to flights departing from Europe.

You may receive up to 600 euro per person (per flight).

Could you be entitled to Pegasus flight delay compensation?

Yes, if:

  • The delay is 3 or more hours;
  • The delay is due to airline’s fault;
  • Your Pegasus flight is from Europe.

By Europe and EU here on this page (and on this website in general) we mean all EU Member States, the United Kingdom (UK), Guadeloupe, French Guiana, Martinique, Reunion, Mayotte, Saint Martin (French Antilles), the Azores, Madeira, the Canary Islands, Iceland, Norway, and Switzerland.

1.1 Extraordinary Circumstances

There are situations when you aren’t entitled to compensation.

If, for example, your flight is delayed due to “extraordinary circumstances”.

It’s something no airline has control over. For example, extreme weather conditions, natural disasters, security issues at the airport, civil and political unrest, terrorism threat and some strikes.

Speaking of strikes, remember this — not all strikes are considered extraordinary circumstances. For example, airline staff strikes aren’t. But strikes untreated to the airline, on the other hand, are considered extraordinary circumstances. If your flight is delayed due to a strike untreated to the airline, you can’t get flight delay compensation.

If your claim is rejected, make sure you double check what you’re told.

Why your claim was rejected? Does the airline claim that the flight was delayed due to extraordinary circumstances, such as bas weather? Check if the weather really was that bad. See what other airlines were doing at the same time. Were there other flights operating from the same airport?

Does the airline claim that technical issues with the aircraft are extraordinary circumstances, too? And that’s why the flight is delayed? If you are in this situation, don’t agree with the airline’s decision. If your flight is delayed due to technical issues, you might get compensation. Technical issues aren’t extraordinary circumstances.

1.2 How to Calculate the Delay Time?

What really matters is the time of arrival at your destination.

This applies both to direct flights and connecting flights.

Calculate the delay time at the moment you arrive at your destination. If you have a connecting flight, your destination is your final destination (your last stop).

Another thing to remember — your actual time of arrival is the moment, when the doors of the airplane are opened and passengers are free to go, not the moment of landing.

1.3 Right to Care

In Europe you also have a right to care.

With Pegasus it applies to flights departing from Europe. If your flight is delayed, and you have to wait for 3 or more hours until it departs, you have a right to receive care from the airline. This means that you are entitled to certain services for free.

Pegasus must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If the flight is delayed overnight, you should be offered accommodation and transportation from and to the airport as well.

All passengers are eligible for this type of care from the airline.
